Who is selling

These terms apply to every purchase made on this site, under both the ithos and cathelier names. Ordering means accepting them.
The pieces
ithos lamps are cut, sanded and painted by hand; cathelier pieces are laser-cut and engraved, and finished by hand. So there are small differences between a piece and its photograph: the grain of the wood, the exact tone of the paint, where a painted detail sits. They are normal in a piece made this way. If a piece does not match what you ordered, the legal guarantee always applies.
Measurements are approximate, to about a centimetre.
The photographs are of pieces we have actually made. The colour on your screen may not be the colour of the wood.
Prices
Prices are in euros. VAT is not charged: article 53 of the Portuguese VAT code applies.
The price you see on a product page is the price for that piece with the choices shown. Shipping is added at checkout and shown before you pay.
Personalised pieces
Everything that features a name, a date or words chosen by you is made just for you, therefore you do not have the right to cancel from the moment the order is paid — this is the exception under point c) of no. 1 of article 17 of Decree-Law no. 24/2014. The legal guarantee remains.
Choosing a colour that we already offer is not personalisation, and it does not take away your right to cancel.
With cathelier pieces, we send you a design to approve before cutting anything. Nothing goes to the laser before you say yes, and what you approve is what you receive.
Ordering and paying
An order is a proposal until we confirm it by email. We may decline an order — if a piece is no longer possible, if the engraving asks for something we will not cut, or if the delivery address is outside the countries we ship to.
Payment is taken by ifthenpay, a payment institution supervised by the Banco de Portugal. You can pay by Multibanco reference, MB WAY, card, Google Pay or Apple Pay. We never see or store your payment details.
If you pay by Multibanco reference, the reference is yours for 2 days. Nothing is made until it is paid: the order is confirmed when the payment reaches us, and we write to you then. A lamp that was in stock when you ordered is kept for you while the reference is valid. If the reference expires unpaid, the order simply lapses, the lamp goes back on the shelf, and you owe nothing — put the basket together again whenever you like.
Making and delivering
An in stock lamp leaves the workshop 3 to 5 working days after your payment.
An out of stock lamp can still be ordered: we will make yours, and it will reach you in 3 to 4 weeks. Each product page and the basket will state which is the case before you pay. If the last one in stock is taken by someone else while you are ordering, we will let you know before receiving any payment, and the decision to wait is yours.
cathelier pieces are always made to order and arrive within 4 weeks, starting from the approval of the design — almost always sooner.
If one item in an order is made to order, the entire order will be sent together once it is ready.
Shipping is handled by MRW. Delivery times are estimates and begin when the order leaves the workshop.
If something is wrong
You have a 3-year legal guarantee on everything you buy here, from delivery. If a piece arrives damaged or does not match what you ordered, write to ithos@outlook.pt, ideally with a photograph. You can choose between repair and replacement, free of charge, unless the one you choose is impossible or disproportionate; and you are entitled to a price reduction or a refund if we do not repair or replace it, if the fault comes back, or if it is serious. If the fault appears within 30 days of delivery, you can ask straight away for a replacement or a refund (Articles 15 and 16 of Decree-Law No 84/2021). See also your legal guarantee rights.
Repair parts
As the makers, we keep the parts needed to repair each piece available for 10 years after the last unit of that model is placed on the market (Article 21 of Decree-Law No 84/2021). If it needs repairing, write to us.

For resellers
These conditions apply when a business we have registered as a reseller buys at reseller prices. The rest of these terms apply too, except where this section says otherwise.
Who is a reseller. A business we have registered under its NIF, company name and registered address. Registration is ours to grant and to end. You sign in with a link or a code sent to the email addresses on the registration.
Prices. The retail prices on this site are recommended retail prices: you set your own resale price. Your price is the retail price less a discount per piece, shown to you while you are signed in; paid options are at their normal price. Shipping and order limits are the same as for everyone. VAT is not charged: article 53 of the Portuguese VAT code applies. Our price list and these conditions are available on request.
Buying for resale is not a consumer purchase. The right to cancel within 14 days (Decree-Law 24/2014) and the 3-year legal guarantee for consumers (Decree-Law 84/2021) do not apply to what you buy for your business. Check the pieces when they arrive and tell us about any visible defect within 8 days (Commercial Code, article 471); hidden defects follow the Civil Code (articles 913 to 922). If you are buying something for your own home and not for resale, do not use your reseller access: buy as a consumer, and every consumer right applies.
Invoices are issued in your company's name, with your NIF and registered address.
When you resell, you are the distributor of what you sell on, and the EU General Product Safety Regulation (2023/988) applies to you: keep the identification, instructions and warnings that come with each piece with it, in Portuguese, and show them when you sell online. If one of your customers has a problem with a piece that came from us, tell us.
Law
Portuguese law applies. Nothing here takes away rights the law gives you as a consumer.
These terms are written in Portuguese. Versions in other languages are translations; if they differ, the Portuguese version prevails.
